"Treasury's reluctance to acknowledge HAMP's shortcomings has had real consequences," the bailout watchdog declared in its report. An "untold number of borrowers may go without help -- all because Treasury failed to acknowledge HAMP's shortcomings in time."



Housing experts have declared that the administration's botched program leaves the broader housing market and the economy susceptible to more shocks ahead, as foreclosed homes pile up, pulling down real estate values.



"Having dragged their feet through various revisions to the program, and with their ability to now redesign it shut down, they have ensured HAMP its place in the trash bin of history," said noted bond analyst Joshua Rosner, a managing director at Graham Fisher & Co. who analyzes housing.



The abundance of data in the oversight panel's report presents a picture of a flimsy government program that has been swamped by an unceasing flood of homeowners landing in trouble and houses sinking into foreclosure. Since the program began, nine new foreclosures have been initiated for every permanent loan modification that has been approved, the panel found.



Under the program, troubled homeowners who qualify are enrolled for three-month trial periods during which they make lower monthly payments. So long as they make their payments on time and document their distressed situation, borrowers are supposed to be automatically rolled into so-called permanent modification plan in which their monthly payments stay relatively flat for five years.



Some homeowners have been stuck in the trial phase for as long as 20 months, according to the Congressional Oversight Panel. The chairman of the panel, former Delaware Senator Ted Kaufman, called that "egregious," during Monday evening's call with reporters. He singled out for criticism the giant banks that collect mortgage payments--servicers, in industry parlance. He also blamed Treasury for failing to hold the mortgage companies to account.



"There is extensive anecdotal evidence servicers aren't living up to the rules," said Kaufman, a Democrat. "Treasury is not nearly being as forceful as they can."



The panel asserted that Treasury can levy penalties on mortgage companies for failing to abide by the program's rules. Treasury insists that it lacks such authority, though it clearly has the power to claw back the incentive payments it makes to servicers for enrolling homeowners in five-year modification plans. Despite heavy criticism from Congress, Treasury has withheld no payments. Treasury is now considering withholding payments for 132 modified loans, the panel's report notes.



Even those homeowners who have successfully navigated the Kafkaesque bureaucracy required to secure a loan modification have rarely received significant relief. Nearly 95 percent of such homeowners have ended up with higher principal balances after receiving a modification, according to the report. More than 76 percent of homeowners in the program owe more on their mortgage than the home is worth, a situation referred to as being "underwater."



About 10.8 million, or 22.5 percent, of all homeowners with a mortgage were underwater as of Sept. 30, according to CoreLogic, a data provider.



A range of housing experts have long argued that the foreclosure crisis can only be stemmed by a more aggressive program that shrinks the outstanding balances on mortgages. The Treasury and the financial industry has long resisted such calls on the grounds that it would cost someone money--either the banks or taxpayers.



Writing down principal balances on mortgages would give people whose are worth less than they owe greater incentive to stay current on their payments, say experts.



"Negative equity is a primary factor holding back the housing market and broader economy," Mark Fleming, CoreLogic's chief economist, said in a Monday statement.



According to the oversight panel's report, homeowners are falling further underwater after their loans are modified under Obama's plan. After their loan is restructured, the typical HAMP homeowner owes $1.25 on their mortgage for every $1.00 their home is worth.



The oversight panel zeroed in on the problem of underwater borrowers as a key challenge for the economy. With so many people underwater, many homeowners who would like to sell their properties and move to parts of the country with more abundant jobs are stuck in place. Some borrowers have opted to simply forego making payments and relinquish their homes to foreclosure.



"Negative equity can restrict the ability of homeowners to move, whether for family reasons or to pursue greater job opportunities, since home sale proceeds will not be sufficient to repay their loan," the report states. "It also provides an incentive for borrowers who can afford to pay their mortgages to stop paying intentionally and walk away."



This dynamic seems likely to worsen before it gets better, with many analysts anticipating that housing prices will continue to fall in much of the country through the end of next year. Housing prices have fallen by 30 percent nationwide since early 2006, according to the S&P/Case-Shiller Home Price Index.



Massad, the Treasury official overseeing the rescue program, said the department grasps that underwater borrowers are playing a significant role in exacerbating the foreclosure crisis. He emphasized that Treasury recently launched additional programs aimed at shrinking balances for people whose homes are worth less than they owe the bank.



But despite these programs, mortgage companies have reduced the principal for only three percent of the homeowners in the HAMP program, according to the the panel's report.



"Clearly, it's a big, big problem," said Kaufman.



Rosner and other experts assert that Treasury should force lenders to write down second mortgages, such as home equity lines of credit--a popular way in which homeowners turned increased real estate values into the cash during the boom. And if writing down those loans still leaves borrowers unable to make their monthly payments, primary mortgages should be written down, he added.



But that approach has been emphatically rejected by Treasury and the large banks, who are themselves on the hook for many second mortgages. While the largest four American banks generally sold off primary mortgages to investors and now merely collect fees for handling the bills, these same four banks themselves hold 43 percent of second mortgages--an amount reaching $420 billion, according to the panel.



That, say analysts, largely explains the dismal state of the administration's foreclosure program and Treasury's unwillingness to champion the only clear remedy: writing down principal balances. Indeed, the oversight panel concludes that forcing lenders to absorb losses on second mortgages could leave the four biggest banks severely crippled.



"Treasury's HAMP program has, in policy and practice, been a colossal failure," Rosner wrote in an e-mail. "Rather than working in the interests of borrowers and investors, whose interests are fundamentally aligned, HAMP appears to have been designed to shield banks and their captive servicers from the negative financial impact that a reasonable resolution to the crisis would require."

The new sheriff in town is not at all blase about the foreclosure fraud crisis.




The latest disclosures are deeply troubling, but they should not come as a big surprise. For years, both individual homeowners and consumer advocates sounded alarms that foreclosure processes were riddled with problems.



While federal and state investigators are still examining exactly what has gone wrong and why, two things are clear.



First, several financial services companies have already admitted that they used “robo-signers,” false declarations, and other workarounds to cut corners, creating a legal nightmare that will waste time and money that could have been better spent to help this economy recover. Mortgage lenders will spend millions of dollars retracing their steps, often with the same result that families who cannot pay will lose their homes.



Second, this mess might well have been avoided if the Consumer Financial Protection Bureau had been in place just a few years ago....



Lost in much of the back-and-forth over wrongful foreclosures is the question of whether the scandal could have been prevented. The answer is yes.



The practices now under investigation took root and grew because there was no single federal regulator with both the responsibility and the tools to look out for consumers.



Had it existed, the new consumer agency could have stopped these problems before they multiplied. Many of the failures already admitted were not sophisticated scams that had been carefully concealed. By enforcing existing laws and involving state authorities early on, the agency could have made sure that the law was respected. No one would need to wonder whether the world of borrowing and lending works only one way: Families have to follow the legal rules, but the rules are optional for big banks....



A mortgage is the biggest financial commitment most Americans will make in a lifetime, and the toll on Florida has been especially heavy and the need for oversight particularly apparent. A few weeks ago, I watched proceedings in a Fort Lauderdale foreclosure court and saw firsthand the painful outcomes for numerous families.



Unfair servicing practices can worsen a family’s already difficult economic situation, and the injury echoes from the family to the community and ultimately throughout the economy. Cops on the beat can stop problems before the damage spreads. If there ever was any doubt that the new consumer agency is necessary, the latest foreclosure developments should put that to rest.



Hopefully, Warren's voice will be heard within the administration not just in preventing future foreclosure fraud crises, but in dealing with this one, and she can counter Geithner's unwillingness to intervene against the banks. It's about time there was a very strong voice in Treasury speaking out on behalf of the borrowers.

Making Money Job

Just last month, rapper 50 Cent tweeted photos of himself playing around with a half million dollars. Now, it looks like his son is a chip off the old block!


Fiddy took to Twitter to post photos of his offspring, being extraordinarily rich, playing with and sleeping on tons of cash.





Mr. Cent tweeted the above photo, saying, “Like father like son he eating. Lol”


He went on to tweet, “Oh my god dad were rich. Lol”, along with, “My dad is getting so much money its making me cry. Lol” and “I need a blood test this kid don’t look like me lol.”


I guess it must be nice to be so bored that he and his son can afford to eat and sleep on money. While you’re slaving over an ancient computer at your crappy nine-to-five job in a cubicle farm, just know that all of us who have ever purchased any of Fiddy’s music, has made it possible for him to act as if money doesn’t mean a thing.


It’s too bad that all of the money in the world can’t fix their looks. Poor guys.

Are you hustling backwards? Are you making decisions that will systemically destroy wealth and place you in a financially dependent situation? Hustling backwards seems to be a favorite past time for many Americans. Many people make decisions that will destroy wealth instead of building wealth.


Debt before Savings


America has become a debtor nation. Debt is easy to come and is very convenient. Debt in the form of credit cards, student loans, and even mortgage debt has been an issue for many Americans. Debt for the purpose of consumption is a bad investment. When one goes into debt they are exchanging future money for current money at a cost. The cost of money is interest. Currently, the interest rate for those with ok credit is 19%. While the highest interest rate for a savings account is 1.10% there is something wrong with this picture. Going into debt and not saving one’s money is hustling backwards. One will never become financially independent going into consumer debt.


Solution: One should begin saving money immediately. A portion of every check should be going into a savings account. Open a high interest rate savings account. Have your funds direct deposited and forget about it.


Consumption before Investing


Consumption seems to be a way of American life. About 40% of the GDP comes from consumer consumption. Consumption became an American mindset as a way to keep the economy growing. However consumption is only short-term. Working hard just to throw money away on useless products is a waste. It is a backward mentality.


Solution: Focus on investing. Instead of always buying products, try investing your money in things that provide a return.


Job before business


There are currently 15 million people that are unemployed. We have become too dependent on employers for our livelihood. Everyone should have another way of making money outside of a job. The days of spending one’s entire career at one job are gone. One should never think job without thinking of some other form of revenue.


Solution: Stop procrastinating and start a business.

Money Making


I've been working in the IT/Internet field since the pre-Google era, so it's been a number of years now. It's been a rough ride of ups and downs, but a great one. Being constantly on the internet, I've always wanted to do something extra, apart from my full time job.


I've tried a million different things and had truckloads of ideas on how to make money online. Forums this, blog that, advert here and advert there, but they all failed. I've read gazillions of documentations, watched hours and hours of presentations about how to make money online — how easy it is to work from home and make over $10,000 a month. Really? Well you want my opinion? Screw all that and do it your own way because YOU LIKE WHAT YOU ARE DOING.


Look at the history of most companies, giant corporations of today, especially the online ones such as Google, Twitter, Facebook and many others. They all started as a hobby, as a project, and never specifically to make money out of the idea. All the founders of the above mentioned companies, believed so much in their idea, that they dedicated their life to building it. It is not a matter of luck that they are who they are today, but it is sheer determination and good ideas. Money is a secondary thing; it's the result of what you've done. I never used to believe this but now I do believe it, been there, done that.


As I specified above, I've tried a million types of online ideas and website, but they all failed because I specifically wanted to make extra money. Thought there was only one thing that I really liked and loved, and never gave it a shot, music! It was always my dream to have the time to discover new bands, to have all their original CDs and albums, and if possible get in touch with them.



This is the second and final part of a series of posts that looks at why I am skeptical that The Giving Pledge will have the kind of impact many people are saying it will. In Part I, I explored how the pledge is likely to have an extremely small impact on total giving, and how little money will likely benefit underserved communities.



Below, I look at how giving by billionaire philanthropists has typically been limited in its effectiveness and has dangerous implications for democratic decision-making.





Billionaire philanthropy has real limits and risks.



Billionaires don't typically like to share power.



Some forward-thinking foundations share power with communities by including grantees or the constituent perspective on their boards. Others share power by giving most of their grants in the form of unrestricted general operating support so that the leaders of the nonprofits can best decide how to spend the money.



But most billionaire philanthropists don't follow these practices. The current trend in philanthropy is to develop highly specific theories of change around narrowly defined issues, and then to look for nonprofits that can carry out the foundation's plan. It's often called "strategic philanthropy." In this approach, the billionaires and their families get to decide what the problems are facing communities and how best to solve them.



"What's wrong with that? It's their money," you might ask.



First, it's not entirely their money. Dollars donated by millionaires and billionaires should be thought of as partially public dollars. Given our current tax code, most gifts by the ultra-wealthy are subsidized at the 35 percent level by other taxpayers. A foundation created with a $1 billion gift is really $650 million from the donor and $350 million from the tax-paying public. When tax-exempt donations are made, the U.S. Treasury forgoes revenue, and other taxpayers pay higher rates to make up the difference.



Second, there are real risks for democracy when we allow billionaires to have undue influence on public institutions. It has been well documented how the charitable choices of the ultra-wealthy are influencing government policy in this country and around the world. For just one example, look to an opinion piece in the Chronicle of Philanthropy, where education historian Diane Ravitch explains, "A foundation's offer of a multimillion-dollar grant is enough to cause most superintendents and school boards to drop everything and reorder their priorities."



Third, having billionaires tightly control the decision-making process is not optimally effective, for three reasons.



  • Overwhelming evidence from groups like Grantmakers for Effective Organizations and the Center for Effective Philanthropy shows that when nonprofits receive unrestricted support, they have greater impact. That's because the people closest to the problems, those running nonprofits, often have important insights about how to find solutions. So to increase impact, billionaire pledge-takers would be wise to give more unrestricted funding.


  • Research by theorist Scott Page demonstrates that diverse groups make better decisions, so a foundation that has a diverse board is likely to be more effective than a foundation with a small board that includes only the donor and a few members of his or her family. Advisory committees are a good half-way step, but there is no substitute for truly sharing power by adding community perspectives to the board of trustees.


  • Another way billionaires often fall short of being optimally effective is that they tend to favor technocratic approaches to solving social problems. Yet, as philanthropy expert Michael Edwards points out in his latest book, many of the most pressing challenges we face are not best addressed with a business-oriented approach. Thorny social problems require investments in civil society and social justice, not technocratic business-driven solutions. Unfortunately, despite the fact that it is well documented that foundation investments in advocacy, community organizing and civic engagement have an incredibly high return on investment, few high-net-worth donors currently focus on promoting social justice in these ways.




    Happily, a few of the billionaire donors who have taken the pledge are leaders in social justice giving. Herb and Marion Sandler are among them -- they're big supporters of grassroots community organizing. Jean and Steve Case, too, have devoted more than 30 percent of their foundation's grant dollars to social justice causes, primarily by investing heavily in civic engagement. But these donors are the exception rather than the rule among billionaire philanthropists.



What's needed to mitigate these risks and limitations is for billionaire pledge-takers to recognize that donors, taxpayers and nonprofits are really all partners in pursuit of the common good. We all have certain rights and responsibilities in this partnership. And as true partners, we need to share power. If signers of The Giving Pledge think about their philanthropy in this way, it will help democratize their work and lead to better results.

Final Thoughts



The Rev. Dr. Martin Luther King, Jr. once noted, "Philanthropy is commendable, but it must not cause the philanthropist to overlook the circumstances of economic injustice which make philanthropy necessary."



As I stated up front, all things considered, I'm glad the Gateses and Mr. Buffett started The Giving Pledge. It's better for our nation and the world to have billionaires giving to charity than to leave vast amounts of their wealth exclusively to their kids. I hope this initiative inspires bolder giving from billionaires, millionaires and the rest of us.



But it's not just the amount of giving that matters. The quality of the giving matters, too.



Thus far, The Giving Pledge has been silent on these questions of quality, following a politically safer route that says implicitly that all charitable giving is noble and of equal value. But that's just not true. The choices philanthropists make determine to what extent the common good is served by their generosity. We should all hope they make good choices.

Making Money Scams

Q. I was charged $1,200 by Debt Solutions of America with the promise that they would lower my house payment. Well they did -- It was $823 a month. Now it's $817. And I'm out $1,200. Is there anything I can to do to recoup my money?

Pamela StaheliA. Pamela, I really hate to hear about cases like yours. With all of the trouble in the housing market, companies like this are popping up more and more. They often call themselves foreclosure rescue or foreclosure relief services, and they promise big things: Lower your mortgage payments, cut them in half, save you thousands of dollars a year.



What they actually do is exactly what you could do on your own, or with the help of a good not-for-profit housing counselor: They help you gather and submit the paperwork needed to complete a loan modification as part of the Making Home Affordable program.



When we received your email, I did a search for the company so I could get in touch and see if we could recoup any of what you lost. What I found, unfortunately, is that this company is already out of business. I did manage to track down Chris Stover, the owner, and he was less than helpful. He said that in order to work with his company, you had to sign a contract that said, essentially, that there are no guarantees.



I know you've acknowledged that you did, in fact, sign this contract. Because the company is out of business -- Stover tells me it "just wasn't a profitable business to be in," although I'm sure you'd disagree -- going after a refund would probably be throwing good money after bad, according to Gerri Detweiler, a credit adviser for Credit.com.



Instead, she thinks you should file a complaint with your state attorney general's office and the Federal Trade Commission (you can do that here). I'd also file a complaint with the Better Business Bureau, which already has a file started on this company, with 10 complaints registered. You can add yours to the list here.



Now, if you're still struggling with your mortgage payments, and it sounds like you are, you should get in touch with a HUD-approved housing counselor. It's completely free, and they'll be able to outline what options are available to you at this point.



Finally, for others out there who are considering one of these services: It's not worth it. There are no quick fixes, and if someone asks you to pay for this kind of counseling service or help with a home modification or a delinquent mortgage, it's more than likely a scam. (As a side note, there are legitimate credit counseling services, which charge a small fee to help you pay down credit card and other debt. If that's what you're looking for, keep your search limited to members of the National Foundation for Credit Counseling.) Whenever you're considering paying for a service of any kind -- debt settlement, credit counseling, even a new cell phone or cable plan -- you should thoroughly research the company, including verifying its rating and accreditation with the BBB.
